The decision on the case of sea pollution near Anapa has been upheld.

The court did not satisfy the complaint against the decision to recover more than 49 billion rubles from the owner and charterer of the tanker with oil products that crashed in the Kerch Strait.

As reported by "Caucasian Knot", in August 2025, the court satisfied the claim of Rosprirodnadzor against the owner and charterer of the tanker "Volgoneft-212" that crashed in the Kerch Strait, ordering LLC "Kamatransoil" (the owner of the tanker) and LLC "Kama Shipping" (the charterer of the tanker) to pay more than 49.46 billion rubles for damage to the Black Sea. In November 2025, the appellate court upheld this decision.

The Fifteenth Arbitration Appellate Court upheld the decision of the first instance court, which ordered "Kama Shipping" and "Kamatransoil" to pay 49.46 billion rubles, reports "Kommersant" today.

The claim from Rosprirodnadzor was considered in an open court session. The representatives of the defendants did not appear in court, attempting to file a motion for participation via video link. However, the court denied the remote format, the publication writes.

A new hearing was scheduled because "Kamatransoil" attempted to review the case based on newly discovered circumstances.

"The appeal is motivated by the fact that the existence of a liability limitation fund for insurers for damage from oil pollution excludes the possibility of recovering damages in the amount of 49,460,085,849 rubles in the general order jointly from the defendants. At the time of the decision on 19.08.2025, the legal fact of initiating the procedure for creating the liability limitation fund already existed, which is why the first instance court's ruling established a significant circumstance that was not and could not be known to the applicant," the text of the ruling dated September 17 and posted in the court registry states.

However, the court concluded that the fact of the creation of an insurance fund by insurance companies is not a basis for revising the already effective decision on recovering damages from shipowners.

"The arguments of the appeal are reduced to disagreement with the established factual circumstances of the case and the assessment made by the court of the evidence available in the case materials, the grounds for re-evaluating which the appellate court does not see. Under such circumstances, there are no grounds for canceling or changing the contested judicial act based on the arguments presented in the appeal," the judge decided.

Recall that in February, the Ministry of Natural Resources of the Krasnodar Territory demanded to recover from the owners and charterer of the tankers more than 34 billion rubles for damage to nature and losses to the regional budget.

In 2025, the Anapa city administration also demanded in court from the owners and charterer of the tankers 211 million rubles, which were spent on eliminating the consequences of the ecological disaster. In August of the same year, the amount of claims increased to 647.4 million rubles.

Claims were filed by officials against the backdrop of dissatisfaction from volunteers regarding the role of the authorities in cleaning up the fuel oil. Thus, in October 2025, the volunteer headquarters "Dolphins" indicated that volunteers had collected about half of the contaminated sand, the removal of which was reported by the authorities, however, in official reports the work of volunteers is not even mentioned.

Fuel oil was found on all beaches of Anapa, on the coast in the Temryuk district, and on the coast of the Azov Sea in the Slavyansky district of the Krasnodar Territory, according to a report from "Caucasian Knot" "The scale of pollution in southern Russia with fuel oil".
