Baku court rejects opposition journalist's complaint against prosecutor's office

The Binagadi District Court of Baku has dismissed the complaint of Mustafa Gadjibeili, an opposition journalist and activist. He intends to appeal against the court decision.

The "Caucasian Knot" has reported that in the evening on February 11, 2020, candidates for MPs and the voters who supported them came out to a protest action in Baku, claiming falsification of the parliamentary elections. The police used force to disperse the protesters. Mustafa Gadjibeili, the head of the press service of the "Musavat" Party and the editor of the "Basta" website, was among the victims. He stated that law enforcers had beaten him up.

On February 5, 2021, the consideration of Gadjibeili's complaint continued at the Binagadi District Court.

The journalist petitioned for adding the video showing policemen detaining him with the use of force and putting him into a car to the case files. "However, the judge dismissed the petition. As a result, despite the conclusion of the forensic medical examination, which confirmed the presence of bodily injuries, the judge upheld the decision of the prosecutor's office to refuse to initiate a criminal case," Mustafa Gadjibeili told the "Caucasian Knot".

He intends to file an appeal against the court's decision. "The court has considered my case in a biased and unfair manner. Moreover, the court violated my right to defence by not allowing my advocate to attend any of the sessions," Mr Gadjibeili has added.
