Strasbourg Court accepts lawsuit of Dagestani rights defender against Khasavyurt OVD

The European Court of Human Rights (ECtHR) has accepted a complaint submitted by Nasurdin Rasulov, a human rights activist from Khasavyurt and the lawyer of the public organization "Fighter for Justice". According to his story, employees of the OVD (Interior Division) of Khasavyurt had illegally initiated a criminal case against him.

Mr Rasulov received a notification that the Office of the ECtHR had accepted the complaint to consideration and awarded it a serial number on August 20.
The lawyer demands in his claim to punish the above employees under Article 306, part 3, of the Criminal Code, dealing with "artificial creation of prosecution evidences." The article assumes a penalty of up to six years of imprisonment, the "Caucasian Knot" correspondent reports.

In October 2009, at the Khasavyurt City Court, Rasulov represented the interests of his client Abdulvagab Rurakhmaev, an invalid, who had been beaten, when they attempted to evict him from the house against his will. Rurakhmaev had documents on him, stating that his eviction was illegal.
"During the session, Khangerei Khizriev, a witness and defendants' relative, suddenly burst into the courtroom. In the eyes of the whole audience he stole my service dictaphone," said Rasulov.

On the occasion of the theft he addressed his application to the investigatory division of the Khasavyurt OVD. "Investigator Saipov concealed the fact of theft of the Dictaphone and failed to mention it in the case file," said Rasulov. "In order to refute the fact of the theft, they planted someone's dictaphone on me," he added.

However, a criminal case on suspicion of a false accusation was initiated against Rasulov himself. For a whole year Rasulov was under inquiry. During this time, he turned to different institutions: the courts and the prosecutor's office. He has five court decisions on recognition of the actions of the employees of the Khasavyurt OVD to be illegal.

According to his story, finally, in October 2010 the criminal investigation was stopped, although the employees in charge suffered no punishment.
The "Caucasian Knot" correspondent was told at the city prosecutor's office that they know nothing about the criminal case against Nasurdin Rasulov.
